Welcome to SafeDeployer. These Terms of Service ("Terms") govern your access to and use of the SafeDeployer website, application, CLI tools, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Description of Service

SafeDeployer provides a zero-downtime deployment orchestration platform designed for single-server VPS instances. The Service includes our web dashboard, APIs, and command-line interfaces (CLI) that manage Docker container deployments, health checks, and proxy traffic routing. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

2. User Accounts and Security

You must be at least 18 years old to use our Service. When you create an account, you must provide accurate and complete information. You are solely responsible for safeguarding your account credentials, API tokens, and any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account. SafeDeployer cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations.

3. Subscriptions, Billing, and Payments

SafeDeployer is offered on a subscription basis. By selecting a subscription plan, you authorize us to charge your selected payment method for the fees corresponding to your plan, including any applicable taxes. Subscriptions automatically renew at the end of their term unless canceled beforehand. All fees are non-refundable unless otherwise required by law. We reserve the right to modify our pricing upon providing reasonable notice.

4. Acceptable Use Policy

You agree not to use the Service in any way that:

  • Violates any applicable national or international law or regulation.
  • Attempts to exploit, harm, or interfere with the integrity, security, or performance of the Service or its underlying infrastructure.
  • Involves reverse engineering, decompiling, or disassembling any portion of the Service.
  • Attempts to bypass any measures we may use to prevent or restrict access to the Service, including rate limits and license restrictions.

5. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of SafeDeployer and its licensors. Our trademarks, trade names, and trade dress may not be used in connection with any product or service without our prior written consent.

6. Disclaimers and Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. SafeDeployer expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements, be completely uninterrupted, secure, or error-free.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SAFEDEPLOYER, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

8. Indemnification

You agree to defend, indemnify, and hold harmless SafeDeployer and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, or a breach of these Terms.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or cancel your subscription from your dashboard.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by updating the "Last updated" date or by sending an email notification. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
